American challenge for Genesis. Ukrainian experts assessed the possible financial consequences of a lawsuit in the US
The lawsuit filed by the US Federal Trade Commission (FTC) against Ukrainian IT giant Genesis has prompted the market to talk about threats to mobile app business models. Amid allegations of deceptive auto-subscriptions and secret debits, Ukrainian entrepreneurs and lawyers have commented on what this case could mean for the company and how much it will cost to defend itself in US courts.

Amid allegations of deceptive auto-subscriptions and secret debits, Ukrainian entrepreneurs and lawyers have commented on what this case could mean for the company and how much it will cost to defend itself in US courts.

The regulator’s current actions are more an attempt to negotiate favorable terms for a settlement than a final court decision, notes Igor Mazepa, CEO of investment company Concorde Capital. According to him, the aggressive tone of the official release of the American agency is a classic tool of pressure.
«The press release is written as harshly as possible to push the company to agree to the maximum possible fine. This is a prelude to negotiations,» explains Igor Mazepa.
According to him, if the case ever reaches court, the regulator will not have enough arguments to hold Genesis and its beneficiary accountable.
Anton Tarasyuk, managing partner of the law firm Legal IT Group, suggests that the likely consequences of the FTC lawsuit could include large fines, compensation to users, as well as the forced shutdown of individual applications or changes to mechanics within Genesis Group products. However, experts do not yet see any real risks of holding business beneficiaries accountable.
Experts believe that the Ukrainian company will face serious financial costs, as protecting interests in American jurisdiction is a complex and expensive process. The services of American lawyers alone in such a case will cost Genesis at least hundreds of thousands of dollars.
The size of the potential fine will directly depend on whether the FTC can prove the systematic and scale of consumer rights violations. The practice of such disputes in the US shows that most cases end with the signing of settlement agreements with the payment of compensation.
For example, in September 2025, the popular education platform Chegg agreed to pay users $7.5 million in compensation for similar complaints about a confusing unsubscribe process. A similar dispute ended with Tinder owner Match, which paid $14 million.
Recall that the US Federal Trade Commission (FTC) filed a lawsuit against Ukrainian IT product company Genesis Tech, its founders and a number of affiliated companies. At the request of the regulator, a federal court temporarily suspended the activities of some Genesis-related structures in the US — they are suspected of deceiving consumers through hidden chargebacks and artificially complicating the cancellation of subscriptions.
