Mexican Estafeta lost a dispute over the domain estafeta.org to a Ukrainian IT company

The Mexican logistics company Estafeta Mexicana SA de CV tried to seize the estafeta.org domain from the Kyiv-based company ESTAFETA Communications LLC through the World Intellectual Property Organization (WIPO), but the arbitration court rejected the claim.

Mexican Estafeta lost a dispute over the domain estafeta.org to a Ukrainian IT company

The Mexican logistics company Estafeta Mexicana SA de CV tried to seize the estafeta.org domain from the Kyiv-based company ESTAFETA Communications LLC through the World Intellectual Property Organization (WIPO), but the arbitration court rejected the claim.

The case was heard from August to October 2025, dev.ua reports.

Estafeta Mexicana claimed that the domain completely replicated its trademark ESTAFETA, registered in Mexico back in 1997, and that the Ukrainian company was using it without legal grounds.

However, the WIPO arbitration panel decided otherwise. Judge Piotr Nowachyk found that Ukrainian Estafeta Communications LLC is a legitimate IT company founded in 2011 that actually uses the estafeta.org domain for its own business, the Estafeta Automotive platform. This service helps insurance companies and car repair shops automate the process of settling claims after road accidents.

«The evidence shows that the respondent used the domain for bona fide commercial activities and not to imitate or interfere with the complainant’s business,» the arbitrator’s decision stated.

The Ukrainian company also provided a certificate of registration of its own trademark «E» (Estafeta Automotive) in Ukraine back in 2011, as well as copyrights for the software.

Mexican Estafeta was unable to prove that its brand is known or used in Ukraine, and that the Ukrainian company registered the domain with «bad intentions.»

«There is no evidence that the defendant sought to exploit the complainant’s brand or create confusion among users,» the findings state.

As a result, WIPO refused to transfer the domain estafeta.org and left it with the Ukrainian company.

Recall that Estafeta Mexicana is one of the largest postal and logistics operators in Mexico, operating since 1979.

In turn, Estafeta Communications LLC is a Ukrainian company registered in Kyiv in 2011. It specializes in developing IT solutions for the insurance and automotive markets.
