Anthropic sued over Claude Max usage limits

Washington resident Carl Kahn filed a federal lawsuit on Monday, accusing Anthropic of overstating the actual amount of Claude usage available to users, Engadget reports .
The lawsuit claims that the actual usage limits on the Max 5x and Max 20x plans are difficult to determine and appear to be lower than the limits the company advertises on its website and in other sources.
For private users, Anthropic offers three paid subscription options. The most economical plan, Claude Pro, starts at $17 per month and promises at least five times more requests per session during peak hours than the free version. The company's website states: "The number of messages depends on their length, the size of attached files, the duration of the dialogue, as well as the selected model or feature." In addition, since April 2025, premium plans Max 5x and 20x have appeared, where the request limits should be 5 and 20 times higher than in the Pro version. The price is $100 and $200 per month, respectively.
"The actual usage provided by the Max 5x and Max 20x plans is significantly lower than advertised," the lawsuit claims.
After starting Claude Code, Kan upgraded to the Max 20x plan in April of this year, but quickly found himself constantly hitting his weekly limits. In just one five-hour session, he spent 15% of his weekly allowance.
The lawsuit seeks class action status on behalf of other U.S. consumers who have purchased a Max subscription since Anthropic began offering it last year.
Anthropic declined to comment.
