This is reported by Opendatabot with reference to the Unified State Register of Court Decisions. In 92% of cases, the reason for the full or partial cancellation of traffic police fines was procedural errors.
Often, the tax service sent documents to invalid addresses, causing letters to be returned, but inspections were carried out anyway. As a result, courts declared such inspections illegal, as were the fines themselves.
At the same time, the DPS appealed to letters from the British tax office regarding payments from the company Fenix International Ltd, which operates OnlyFans. But the courts decided that this letter is a reason for an inspection, but not proof of income. Such proof can be bank statements, contracts, etc.
According to Opendatabot, the largest fine that was successfully overturned was imposed for an alleged $400,000 in income, and amounted to UAH 3 million. The plaintiff from Kyiv provided bank statements in court that did not confirm these amounts, and successfully challenged the assessment.
In one of the cases, the OnlyFans model herself wrote a request to the British tax authorities, who officially confirmed that they did not transfer any information about her. Since the Ukrainian tax authorities referred to data that did not exist, the court sided with the plaintiff.
Recall that in March, the Odessa District Administrative Court declared unlawful all tax notices-decisions that assessed a woman over UAH 250,000 in debt for allegedly received income from the OnlyFans platform.
Last December, the tax service in Transcarpathia published an explanation for Ukrainians who received payments through OnlyFans. It states that these receipts are treated as foreign income and must be included in the annual declaration. Even if the account is deleted, there are no statements, and the tax authority has not provided official data on the amounts.
