According to Bloomberg Law, a federal judge has ruled that the subject of Elon Musk’s ketamine use will be closed to lawyers for OpenAI and Sam Altman in the upcoming trial over his fraud lawsuit. The case involves Musk alleging that OpenAI deviated from its non-profit principles and effectively defrauded him as a co-founder.
The essence of the decision is that the court did not see a sufficient connection between this topic and the subject of the dispute. Therefore, the focus of the upcoming trial should remain on whether OpenAI really reneged on the promises with which it was created, and whether there were signs of fraud in the actions of its management. Earlier, the judge had already made it clear that this case could go to a full jury trial, and not end at the preliminary stage.
For OpenAI, this means that in court it will have to defend itself primarily on the merits of Musk’s claims, without trying to shift the focus to his personal behavior. For Musk himself, this is an interim procedural victory, because one of the potentially toxic topics for him will not be in the jury’s field of attention. At the same time, the decision itself does not determine the outcome of the case, but only outlines the limits of what the parties will be able to use during the trial.
Musk’s lawsuit against OpenAI has been going on for over a year and concerns the company’s transformation from a non-profit research organization to a business with a huge market valuation and deep collaboration with Microsoft. The question of when OpenAI’s management began moving toward a profitable model and what Musk knew about it remains one of the central issues in the upcoming proceedings.
