The automatic military registration system could re-register already excluded men. The court ordered the Cabinet to fix this
Following the decision of the Court of Appeal, the Cabinet of Ministers must change the rules for automatic military registration through state registers. The court found illegal the rules that allowed the system to re-register even men who had previously been legally excluded from it, and did not provide a simple way to correct such an entry without going to court.
Following the decision of the Court of Appeal, the Cabinet of Ministers must change the rules for automatic military registration through state registers. The court found illegal the rules that allowed the system to re-register even men who had previously been legally excluded from it, and did not provide a simple way to correct such an entry without going to court.
This was reported by the Judicial and Legal Newspaper. The decision in case No. 320/31215/25 was announced by lawyer Darya Tarasenko, who represented the plaintiff.
The Sixth Administrative Court of Appeal declared the norms according to which this mechanism operated unlawful and obliged the Cabinet of Ministers to provide a procedure for correcting erroneous registration.
"It was a complex and exhausting case, where they tried to hinder us at all stages, but the result is fundamental for the entire legal system. The first instance denied us, so we pressed with all possible legal arguments in the appeal," Tarasenko said.
As part of the automatic verification, the State Migration Service transfers data about men to the Ministry of Defense. The information is then cross-checked with military and other state registers via electronic data exchange. If the system does not find a man aged 25 to 60 on the military register, he can be placed there automatically — without going through the VLK.
But the automatic system did not take into account why a person was not registered. This meant that those who had previously been officially excluded, for example, after being declared unfit for military service, could also be re-registered.
According to the case materials, this is exactly what happened to the plaintiff. In 2017, he was declared unfit for military service and removed from the register. However, after automatic verification in 2025, information about his military registration again appeared in the register.
Now the Cabinet of Ministers must bring the relevant norms of the automatic verification procedure into line with the law "On Military Duty and Military Service" and separately prescribe a mechanism by which erroneous military registration can be canceled.
The decision of the Court of Appeal entered into force on September 16. However, lawyer Darya Tarasenko expects that the Cabinet of Ministers may appeal it to the Supreme Court.
Previously, dev.ua wrote that in September 2025, the Cabinet of Ministers regulated the automatic registration of men aged 25–60 who are not registered for military service without legal grounds. Now, the Court of Appeal has declared part of the norms under which this mechanism operated unlawful.
