After the IT audit, there were no mass cancellations of reservations. How can companies increase quota?

A major audit of critical enterprises ended on September 1, but there seems to have been no mass cancellation of reservations in Ukrainian IT. Clusters estimate the number of reserved IT workers at around 20,000. Also, some ways to increase the quota available to companies are still working.
Kharkiv IT Cluster reports that 90% of companies that submitted documents confirmed their criticality on time. And in IT Dnipro Community, the result is even better: all companies for which reconfirmation was relevant retained the status of a critical enterprise.
However, there is still no complete picture of the entire IT sector. The state has not published data on how many companies retained criticality after the audit, how many lost it, and how many gained it for the first time.
Bookings at large IT companies have not dropped significantly either. SoftServe continues to book several hundred specialists after the audit. At EPAM, 49% of military personnel have reservations - after the audit, their number has not changed. And at Ciklum, it has even increased slightly: now more than 50 people are booked there.
However, the government has already limited one of the possibilities to artificially "inflate" the quota. Previously, an employee who had a deferment for another reason or was officially employed by several companies at once could be included in the calculation of the quota of several employers at once. Now he is taken into account only in one company - where the employment relationship has lasted the longest.
However, an employee who already has a deferment and does not need a reservation from the company can still increase the total number of military personnel in the state. And it is from her that the standard quota of 50% is calculated.
So if a company has 20 military conscripts, it can reserve 10. If it hires another 10 employees who already have deferment, the calculation will be 30 people — and the company can reserve 15.
Another way to exceed 50% is to not review reservations after a staff reduction. If there are fewer military personnel and the number of reservations already issued remains the same, the actual share may exceed the allowed limit.
There are also completely legal ways to reserve more than 50%. For example, ultimate beneficial owners of a critical company who do not work for it can be reserved outside the general quota. Up to 100% of employees can also be reserved by individual critical enterprises that are registered and actually operate in the territories of active or possible hostilities designated by the state.
After the audit, IT clusters propose to change the approach to booking itself. Among the proposals are to completely transfer criticality receipt to an electronic format, to make the procedures of the Ministry of Digital Economy and the OVA identical, and to move away from the universal quota of 50%. Instead, they propose to take into account, for example, the role of specific employees, the company's participation in defense or state projects, its exports, and tax contributions.
Previously, dev.ua wrote that after the change in the rules, all critical enterprises had to reconfirm their status by September 1.
