The Cabinet of Ministers of Ukraine has officially updated the rules for reserving military personnel and created a Coordination Center for Organizing Reserving. The government has also instructed ministries and regional military administrations to review the sectoral and regional criteria by which enterprises receive the status of critical.

For enterprises of the fuel and energy complex (FEC) and the defense-industrial complex (DIC), the maximum reservation level was set at up to 95% of military-liable employees. The Ministry of Economy and Environment of Ukraine announced the changes on October 24. The Cabinet of Ministers adopted the decision at a meeting on October 23.

Criticality criteria should be reviewed in 10 days

The government has clarified the definition of critical importance of enterprises. Therefore, central executive bodies and regional military administrations must review sectoral and regional criteria within 10 days of the changes coming into force. The updated requirements will be coordinated with the Coordination Center.

Simultaneously The review of the criteria does not mean that all enterprises will automatically lose their critical status. According to the Ministry of Economy, enterprises that received the status based on criteria that will not change as a result of the review will retain it.

Separately, the government emphasized that criticality should be determined based on the real role of the enterprise in ensuring defense, the economy, and the livelihoods of the population, and not just its economic indicators.

Why was the Coordination Center created?

The Coordination Center for Organizing Reservations is a temporary advisory and consultative body of the Cabinet of Ministers. It will involve representatives of government bodies responsible for the economy, defense, security, humanitarian policy, and critical infrastructure. The center will be co-chaired by the Deputy Minister of Economy and Environment and the Deputy Minister of Defense.

Among the main tasks of the center:

  • to coordinate sectoral and regional criticality criteria and propose changes to them;

  • consider applications from government agencies regarding the designation of enterprises as critically important;

  • provide recommendations on the cancellation of such status, in particular if there are grounds provided by law enforcement agencies;

  • agree on an increase in booking volumes of more than 50%.

The center must consider the appeal of state bodies within a month. If there is a justified need for urgent consideration, proposals and recommendations must be provided no later than seven working days from the receipt of the appeal.

At the same time, the center will not cancel the critical status on its own: the final decisions on determining enterprises as critical remain with the authorized state bodies. They must consider the center’s proposals.

Who will be affected by the 95% limit?

The government has set a maximum reservation level of up to 95% of military-liable employees for enterprises in the fuel and energy and defense-industrial complexes.

According to the Ministry of Economy, the restrictions will primarily apply to support and maintenance personnel. Employees who directly ensure production, the implementation of defense contracts, operational, repair and emergency recovery work must be fully booked.

The head of the enterprise will determine who to book within the established limit.

Also, when calculating the maximum percentage, employees who have a deferral for other reasons, including parents and guardians with many children, will be taken into account.

What about other quotas?

When calculating the quota, parents with many children and guardians who have other reasons for deferment will be taken into account.

An enterprise may be denied an increase in the limit if its manager has at least two confirmed violations of military accounting rules during the year.

You will have 10 business days to complete an additional reservation through "Diya". If you do not meet this deadline, the decision to increase the limit will become invalid, and after the increased quota expires, the corresponding deferrals will be canceled within five business days.

If the enterprise does not meet the criteria or there are proper grounds for revoking the status, the Coordination Center will be able to consider relevant applications and recommend revoking the criticality, in particular based on information from law enforcement agencies.

However, the mere fact of revising the criteria does not mean that all enterprises must lose their status or go through the procedure again from scratch. The consequences will depend on which criteria are changed and whether a particular enterprise meets them.

The government explains the innovation by the need to maintain a balance between the needs of the Defense Forces and the operation of the economy and critical infrastructure.
