They want to allow Ukrainians to receive compensation for destroyed non-privatized housing. What will the new bill change?
Ukrainians who lost non-privatized state or communal housing due to the war want to be given a path to compensation. The Verkhovna Rada has registered government bill No. 16012, which will allow them to privatize an apartment or house even after they have become dilapidated due to Russian shelling.
Ukrainians who lost non-privatized state or communal housing due to the war want to be given a path to compensation. The Verkhovna Rada has registered government bill No. 16012, which will allow them to privatize an apartment or house even after they have become dilapidated due to Russian shelling.
Currently, the law prohibits the privatization of emergency housing. Therefore, tenants of state and communal apartments may find themselves in a worse situation than owners of privatized apartments, because Russian shelling deprives them of the opportunity to register the apartment as their property. And without ownership rights, you cannot receive compensation under the eRecovery program.
The new bill proposes to make an exception for such cases. If an apartment, house, or dormitory room became an emergency due to hostilities, terrorism, or sabotage related to Russian aggression after February 24, 202, they will still be able to be privatized. The damage or destruction will need to be confirmed by a certificate or inspection report. After that, a person will be able to register ownership and, as the owner, apply for compensation.
The bill also proposes to prohibit the privatization of state and municipal apartments, houses, and dormitory rooms in communities under occupation.
Previously, dev.ua wrote about the experience of Ukrainians who tried to receive compensation under the e-Restoration program. Lawyers then cited the lack of registered property rights as one of the main reasons why compensation may be delayed or denied.
“The only place that didn’t collapse was the bed I slept in.” After the arrival of the “shaheed,” the Head of Recruitment has been waiting for the conclusion of the “e-Recovery” commission for almost three months, while her house in Dorohozhychi continues to collapse.
