«On September 15, 2025, criminal proceedings against Inzhur Energy, initiated on January 13, 2025 on charges of illegal construction of a power plant, were officially closed. The plant with an installed capacity of 35 MW is being built by 5,000 Ukrainians at their own expense under contracts concluded with the state-owned company UKRENERGO,» Zhurzhiy emphasized on his Facebook.
He added that the proceedings were closed due to the absence of elements of a criminal offense in the act (clause 2, part 1, article 284 of the Criminal Procedure Code of Ukraine).
In August 2024, Inzhur Energy won the auction of NPC Ukrenergo, according to which they must build a gas-fired power plant with a first stage capacity of 18 MW, which is planned to be launched by October 2025.

Currently, the construction of a gas-piston shunting power plant near Kyiv has begun, and we have already signed a contract with Ukrenergo for five years. At the same time, we are immediately designing the generation for 36 MW, not 18 MW, because we understand the prospects of this type of service. We received technical conditions for connection to the electricity and gas grid, signed a contract for the supply of a gas-piston installation, and paid the guarantee fee to Ukrenergo,» Andriy Zhurzhiy said .
The construction of the Inzhur Energy power plant was suspended by a court decision in April 2025. As Forbes Ukraine reported, the reason was the protest of some local residents against the construction of the facility, which could theoretically become a target for Russian missiles, and the prosecutor’s office’s claim that the plant violates urban planning regulations.
According to Zhurzhiy, only two investigative actions were carried out in the criminal proceedings over 8 months.
«A survey of the land plot in January 2025 resulted in the prosecutor fabricating evidence about the location of the future station directly on a high-pressure gas pipe. This became the basis for an unjustified halt to the construction of the station for almost three months,» said the founder of Inzhur.

He said that in August, after the prosecutor was removed and a new group of prosecutors was appointed, a second inspection of the site was conducted, which refuted the results of the previous one.

Although it was officially communicated that the case was initiated at the request of residents. In this situation, I have only one question: who and when will be held accountable for the illegal suspension of the construction of critical infrastructure during the war and the damage caused?», Andriy Zhurzhiy pointed out.
UPDATE. On September 25, Inzhur Energy announced that the court had once again suspended construction of the power plant in Sofiivska Borshchahivka. This was reported by Forbes Ukraine, citing the company’s press service.
It is reported that the Kyiv Court of Appeals prohibited Inzhur Energy and Smile Construction from continuing construction and rejected the request to postpone the hearing until the completion of the review of the legality of the construction, which ended on the same day.
Andriy Zhurzhiy noted that Inzhur Energy received the results of the review confirming the legality of the power plant construction an hour after the court’s decision. The company plans to file an appeal against this decision.
