The Ministry of Digital Affairs has expanded the criteria for booking employees to 14 points

This is stated in the order dated 05.12.2024 No. 182, as reported by Liga Zakon. Now an enterprise is recognized as important for the national economy if it meets one or more of 14 criteria:

• The enterprise supplies the core of the electronic communications network to providers of electronic communications services using mobile communication networks, providers of electronic communications services of the data processing center, providers of electronic communications networks that provide access services to the Internet traffic exchange network, determined by the Ministry of Digital Affairs as critically important for the functioning of the economy and ensuring the livelihoods of the population during a special period in the field of digitalization;
• the enterprise is a provider of electronic communications services of a data processing center, a provider of electronic communications networks, which provides access services to the Internet traffic exchange network;
• the company administers the public top-level domain .ua or .ukr;
• the enterprise is a provider of electronic communication services;
• the enterprise is a supplier of electronic communication networks;
• the enterprise is an operator of a critical infrastructure facility in the «electronic communications» subsector of the «digital technologies» sector, which is confirmed by information from the Register of Critical Infrastructure Facilities about the operator of the critical infrastructure facility;
• the enterprise carries out radio frequency monitoring of the use of the radio frequency spectrum by general users, performs calculations of electromagnetic compatibility and assignment of radio frequencies;
• the enterprise performs the functions of administrator of the centralized database of ported numbers;
• ensure the provision of electronic trust services — the enterprise is a qualified provider of electronic trust services, and has generated qualified electronic signature certificates in an amount of at least 1 thousand for the previous reporting year;
• carry out activities in the IT industry — the enterprise carries out one or more types of activities defined by part four of Article 5 of the Law of Ukraine «On Stimulating the Development of the Digital Economy in Ukraine» (Diya City), and also has:
  • the average salary of insured persons — employees at the enterprise for the last calendar quarter is not less than the equivalent of 1,200 euros;
  • the average number of insured persons — employees at the enterprise for the last calendar quarter is at least nine people, as confirmed by a certificate (in any form) provided by the enterprise;
• ensures the functioning of public electronic registers and/or databases, national electronic information resources, information (automated) systems, information and communication systems of central executive authorities;
• ensures the development of the IT industry — the enterprise provides non-refundable financial assistance to private sector business entities that conduct innovative activities, implement innovative projects, carry out activities to create technologies, activities related to creative industries, scientific activities, scientific and technical activities — if the amount of financial assistance provided is at least 30 million hryvnias for the previous calendar year and/or in the current year, which is confirmed by information on agreements on the provision of financial support;
• provide information counteraction to the aggressor using information (automated), information and communication systems, as well as on the Internet;
• ensure the development of innovations and technologies for defense needs.

We will remind you that in early December , the Ministry of Economy resumed granting critical enterprise status for bookings .

Last week, the Land Forces responded to claims about cases of mobilization of reserved employees. They explained that employers are required to issue a deferral from military service at the district (city) territorial recruitment and social support center, in whose territory they are located. If the reservation was not issued through «Diya», it does not appear in «Oberig» automatically.
