The Antimonopoly Committee of Ukraine (AMCU) has imposed a fine of UAH 17.5 million on Kyivstar for misleading advertising that their mobile Internet is the No. 1 in terms of speed. The company notes that it relied on the results of a study by an independent international company.

This was reported by the Chairman of the Antimonopoly Committee of Ukraine Pavlo Kyrylenko on his TV channel, announcing the results of the consideration of the relevant case.
The reason for the sanctions of the antimonopoly authority is that Kyivstar resorted to "inaccurate information regarding the leadership in mobile Internet speed."
The position of the state body is that "the statement "No. 1 mobile Internet speed" together with information about the source, the periods of the relevant measurements and the average indicators obtained from their results, is placed in a way that makes it difficult to perceive it simultaneously with the main statement."
Thus, Kyivstar's actions are recognized as the dissemination of misleading information.

The company shared its official position on the fine: "Kyivstar respects the role of the Antimonopoly Committee of Ukraine in ensuring fair competition and protecting consumer rights, and also cooperates constructively with the Committee."
At the same time, the company does not share the AMCU's previous conclusions regarding the use of the advertising claim "No. 1 mobile internet speed" and considers them unfounded. Kyivstar emphasizes that the communication met the requirements of current legislation, and consumers were provided with all the necessary information to properly understand the advertising message.
"Using the results of research by the independent international company Ookla®, on which Kyivstar's advertising claim was based, to confirm marketing claims is a common practice in the global electronic communications market. Kyivstar applied exactly this approach, properly disclosing information about the data source, the research period, and other material conditions for using its results," the company explained.
Kyivstar also stated that they will appeal the fine in court in accordance with current legislation.
