Business asks the Cabinet to extend the deadlines for updating criticality and existing reservations for 2 months
The European Business Association (EBA) has appealed to the Government of Ukraine to extend the current reservations for 2 months and move the deadline for updating the criticality to April 30. One of the reasons for the extension is the December cyberattack by the Russian Federation.
The European Business Association (EBA) has appealed to the Government of Ukraine to extend the current reservations for 2 months and move the deadline for updating the criticality to April 30. One of the reasons for the extension is the December cyberattack by the Russian Federation.
The request for an extension of the deadlines is due to the fact that after the cyberattack at the end of 2024 and the rather long restoration of state registers, the reservation system and, most importantly, granting companies critical status did not work all this time, the EBA writes .
The suspension of registers also led to the fact that most authorities approved their sectoral and regional criteria with significant delays.
"Because of this, a large queue of applications for such status has accumulated at the level of ministries and local authorities. It is obvious that by February 28, the state apparatus will not be able to process all applications and provide the appropriate status to all truly critical enterprises," the statement says.
That is why the business community is requesting to re-extend the validity of existing reservations for 2 months and move the deadline for updating criticality to April 30, in order not to overload the limited capacities of the current criticality provision system and to contribute to the stable operation of the Ukrainian economy.
"In addition, the legal gap in the criteria and procedure for granting criticality in terms of submitting tax reports for the 4th quarter of 2024 may cause a large number of refusals to grant such status," the business community notes.
The point is that applications for criticality are submitted in January, and tax reporting for the 4th quarter of 2024 is submitted in the second half of February. Accordingly, it is necessary to make urgent changes to the criteria and procedure for granting criticality, namely, to allow reporting for the last reporting period for which the reporting deadlines established by the Tax Code have expired, in particular, to submit a report for the 3rd quarter of 2024 during January and February 2025.
