Now, OpenAI has said it will comply with the order and allow regulators to evaluate the capabilities of its models before they are released to the public.

“It is absolutely right that democratic governments should play a major role in how this technology is used and implemented,” said George Osborne, OpenAI’s head of international affairs. “We suggest that governments create strong regulatory bodies, but with a high degree of flexibility in how they operate in the future.”
The initial draft of the executive order, developed in consultation with various stakeholders, balanced the concerns of the AI industry with public safety. Companies would have been required to submit their models for review 90 days before official release, but participation in the process was voluntary. However, industry insiders such as David Sachs and Elon Musk reportedly warned that the bill could have a chilling effect on the development of AI technologies.
Trump and his advisers later created a new, stripped-down version of the order, shortening the review period to just 30 days. The document encourages (but does not require) AI companies to participate in a benchmarking process. This is necessary to assess the advanced cyber capabilities of AI models and determine whether they should be classified as “advanced models,” which could limit their distribution and sale.
But critics said the order lacked the necessary rules to control potentially dangerous models. “This is a weak policy that reflects the Trump administration’s broader tendency to create a Wild West environment for AI,” said Congressman Don Baier, who co-chairs the House Intelligence Caucus.
