The head of PlayCity, Gennady Novikov, proposes to differentiate fines for violations in the field of gambling advertising based on the degree of social risk.

The head of PlayCity, Gennady Novikov, said in an interview with the Interfax-Ukraine agency that the fine for advertising illegal businesses will be higher after the introduction of a differentiated system of fine distribution.

"Regarding the (current) size of the fine: we do not determine it, we only apply it, since it is prescribed in the law. In the future, we plan to differentiate violations by the degree of social risk: the fine for advertising an illegal business will be larger, for less significant violations - smaller," Interfax-Ukraine quotes Novikov.

The head of PlayCity once again emphasized that for advertising the gambling business, media must have a warning about the age of 21+. Sites without media status are prohibited from such advertising at all. Novikov added that Instagram bloggers are not considered media.

At the same time, the head of the regulator emphasized that the issue of imposing fines on advertising customers remains, since in most cases the advertising distributor does not disclose the customer, as a result of which a fine is imposed only on the person who distributed it.

The head of the regulator raised the issue of joint and several liability for advertising violations. Currently, fines are paid mainly by distributors, since they do not disclose customer data. Novikov proposes to change the approach: if the platform names the customer, the financial penalty should be shared between both parties so that all participants in the process are responsible.

He paid special attention to the regulation of social networks. According to Novikov, although the number of illegal casino advertisements on Telegram has decreased, the platform remains difficult to control. The main problem at the moment is the lack of the ability for Telegram Ads to target content to an audience of 21+, so the regulator plans to prescribe clearer mechanisms for influencing such platforms.

Earlier, the Minister of Digital Transformation, Mikhail Fedorov, reported that licenses for the operation of the gambling business will be available through the "Diya" service.

As a reminder, PlayCity fined the owner of the channel "Trukha Ukraine" 4.8 million UAH after checking the content for compliance with the law. Similar sanctions were also imposed on LLC "SPORT SEGODNYA" , which owns the sports website Tribuna. Currently, dev.ua is appealing the fine.
