According to the case file, the man, using the Telegram messenger, contacted a person not identified by the pre-trial investigation, with whom he agreed in advance to produce the specified documents.
On January 5, he submitted his personal data and a photo card to enter information in a temporary conscript card and a certificate from the military medical commission, which, together with other documents, give the right to cross the state border of Ukraine during the legal regime of martial law.
Subsequently, a person not identified by the pre-trial investigation produced forged official documents — a temporary certificate of conscript and a certificate from the military medical commission, indicating in them notoriously unreliable information about the programmer’s unfitness for military service with exclusion from military registration, and handed the documents to the customer.
On January 23, during border control, while at the checkpoint for international road traffic, Ustylug provided known forged documents to the employees of the State Border Service of Ukraine, and was immediately exposed by the border guards.
Interrogated at the court hearing, the accused programmer fully admitted his guilt in committing criminal offenses. He explained that at that time he was working as a programmer in an IT company, which announced at the beginning of the year that it was terminating cooperation with Ukraine, and in connection with this, he began to look for legal opportunities to go abroad for work.
Since he did not find legal options, he was forced to act in an illegal way. The fake documents cost the man $1,000. The man sincerely repents and asks not to be severely punished.
After reviewing the case materials, the court found the programmer guilty of forging documents and using them and fined him UAH 51,000.
Also, the husband must pay UAH 3,029.12 for conducting examinations.
Seizure of property, imposed by the decision of the investigative judge of the Volodymyr-Volyn city court of the Volyn region dated January 25, 2024, should be canceled.
An appeal against the court’s verdict may be filed with the Volyn Court of Appeal through the Volodymyr-Volyn City Court of the Volyn Region within thirty days from the moment of its pronouncement.
