The Volyn Court of Appeal considered in an open court session the materials of the criminal proceedings on the appeal of the programmer of LLC «MEGOGO», who was found guilty of committing criminal offenses involving forgery and use of knowingly forged documents when crossing the border.
The court of first instance sentenced the man to one year of imprisonment.
The court established that at about 3:20 p.m. on March 5, 2024, while passing border control at the Yagodyn international railway crossing point, the programmer provided employees of the State Border Guard Service with https://reyestr.court.gov.ua/Review/129037684documents knowingly forged in his name stating that he was unfit for military service and allegedly deregistered, as a basis for crossing the state border of Ukraine in wartime.
Using his own computer, Aitivets produced a temporary military conscript certificate and a certificate from the military medical commission in his own name, indicating in these documents knowingly false information about his unfitness for military service with exclusion from military registration, and certified them with forged seal impressions, as well as affixed forged signatures of authorized persons of the specified institutions.
In the appeal filed, both the defense attorney and the accused, without disputing the factual circumstances of the case and the qualification and requalification of the programmer’s actions, consider the court’s verdict illegal due to the incorrect application of the criminal law and the inconsistency of the imposed punishment with the severity of the crime and the accused’s personality, and the groundless and unmotivated imposition of an excessively severe punishment. They request that the verdict of the court of first instance be overturned and that a fine of UAH 17,000 be imposed.
The court partially granted the appeal of the programmer’s defense lawyer.
The verdict of the Lyuboml District Court of the Volyn region dated April 16, 2025 was changed, reducing the punishment to a fine of UAH 17,000.
A cassation appeal against the ruling may be filed directly with the Supreme Court within three months from the date of its promulgation.
