According to the case materials, a native of the city of Energodar, Zaporizhia region, a developer-tester at Playtina LLC, in September 2024, while in the Obukhov forest, noticed wild hemp plants, which is a narcotic drug whose circulation is limited to cannabis, which he identified by its external and odorous characteristics.
The AIT resident suddenly developed a criminal intent aimed at illegally purchasing and storing a narcotic drug, the circulation of which is restricted to cannabis.
Implementing his criminal intent, the tester, acting with direct intent, acquired by finding plantations of the narcotic drug «cannabis», from which he tore off several branches with leaves and tops (inflorescences). After that, he placed them in a plastic bag, which he moved and hid in the same forest on the same day, thereby intentionally illegally acquiring and storing a green plant-based substance, which is a narcotic drug, the circulation of which is restricted «cannabis».
Subsequently, the man crushed the specified hemp plants with his hands, thereby producing a narcotic drug whose circulation is restricted — cannabis.
Knowing for sure that the substance was stored in the forest opposite house No. 16 on Myru Street in Obukhiv, in May he decided to take it and later placed it in a glass jar, which he put in the pocket of his jacket for his own use without the purpose of selling it.
On the same day, the man was detained by police officers — the drug cannabis, which the latter had illegally purchased and stored under the above circumstances, was seized from him.
The seized cannabis was sent for plant substance testing — the examination found that it was a narcotic drug whose circulation was restricted, the total weight of cannabis in terms of dried substance was 12.34 g.
Thus, the programmer was held accountable for his intentional actions, which resulted in the illegal manufacture, acquisition, and storage of a narcotic drug without the purpose of sale.
The specified circumstances were established by the pre-trial investigation body and are not disputed by the participants in the legal proceedings.
The accused, in the presence of his defense attorney, made a written statement in which he admitted his guilt without question.
The man was found guilty and sentenced to a fine of 17,000 hryvnias.
