In Transcarpathia, a programmer was accused of attempting to illegally cross the border, but the court did not hold him accountable. We tell you why
The Uzhhorod City District Court of the Transcarpathian region considered the case regardinga programmer who works at the IT company winwin.travel. The man was brought to administrative responsibility for attempting to illegally cross the state border of Ukraine outside checkpoints as part of a group of people. The proceedings were opened based on materials from the border guard service.

What was the IT worker accused of?
According to the border guard protocol, on January 4, 2026, the programmer was detained in a controlled border area about 5 km from the state border of Ukraine in the direction of the Slovak Republic. The document referred to an alleged attempt to illegally cross the border on foot outside the checkpoints.
The IT specialist himself did not appear at the court hearing, but filed an application to consider the case without his participation. His interests were represented by a lawyer, who insisted on the absence of an incident and the absence of an administrative offense.
What did the court pay attention to?
During the consideration of the case, the court examined the materials provided by the border service and drew attention to a number of procedural points. In particular, the protocol did not clearly describe which actions of the person indicated an attempt to cross the border.
Also, the case materials did not contain evidence of active actions aimed at crossing the border; there was no photo or video evidence; the very fact of being in the border zone was not supported by evidence of an intention to evade control.
The court separately emphasized that the concept of «attempts» implies deliberate active actions, not just the presence of a person near the state border.
What decision did the court make?
Having assessed the evidence taking into account the standard of proof «beyond a reasonable doubt» and the principle of the presumption of innocence, the court concluded that the case could be continued.
Based on the results of the hearing, the court adopted a resolution determining the further fate of the administrative case against the programmer.
The decision can be appealed to the Transcarpathian Court of Appeal within ten days.
