According to the case materials, the AIT resident and another violator were detained by border guards at a distance of 15,760 meters from the State Border of Ukraine and 1,850 meters from the settlement of Butivka. According to the border guards, the violators were planning to flee to Belarus.
The guilt of the AIT citizen was proven by the report examined in the court session, the written explanations of the fugitive, the protocol on the administrative offense, the scheme of the area for detecting the violator of the State Border, and the certificate based on the results of the filtration and verification measures carried out.
When imposing an administrative penalty on an offender, the court takes into account the nature of the offense committed, the identity of the offender, the consequences that occurred, and the fact that the offense was committed by a person of draft age under martial law, which significantly aggravates the committed act and requires severe punishment.
The court found the man guilty and brought him to administrative responsibility in the form of administrative arrest for a period of 10 days. The violator will also be charged a court fee of UAH 605.60.
The judge’s ruling in a case of an administrative offense may be appealed by the person who has been brought to administrative responsibility, his legal representative, defense attorney, victim, his representative or prosecutor within ten days from the date of the ruling to the Chernihiv Court of Appeal through the Horodnyanskyi District Court of Chernihiv Region by filing an appeal.
