Samsung programmer detained 25 km from the border and charged with attempting to leave illegally. What the court decided
A programmer from Samsung R&D Institute Ukraine was tried in the Transcarpathian region. Border guards detained him near the village of Lazeshchyna and accused him of attempting to illegally cross the state border with Romania.

According to the case file, on May 25, 2026, the border guard detained the man along with three other Ukrainian citizens in a controlled border area in the Yasinyanska community. The report stated that the group allegedly attempted to illegally cross the Ukrainian-Romanian border outside the established checkpoints.
Based on this, an administrative report was drawn up against the programmer for attempting to illegally cross the state border as part of a group of people.
The ruling states that the man was detained approximately 25 km from the state border. At the same time, the border service did not provide the court with any photos, videos, or other evidence that would confirm that he directly committed or attempted to commit an illegal border crossing.
«From the evidence presented to the court, it is impossible to establish that the programmer’s actions contain signs of an administrative offense,» the decision states.
The court also emphasized that the accusation cannot be based on assumptions, and all doubts regarding the proven guilt of a person must be interpreted in his favor in accordance with Article 62 of the Constitution of Ukraine.
During the consideration of the case, the Rakhiv District Court of the Transcarpathian region concluded that the evidence provided was insufficient to confirm the offense. As a result, the judge closed the proceedings due to the lack of elements of an administrative offense. The court fee in the amount of UAH 665.6 was transferred to the state.
