According to the case materials, the man was detained near the village of Tarashani, Chernivtsi region, on May 31. In the report, the border guards noted that he allegedly moved towards the state border outside the checkpoint and attempted to illegally cross the border.
An administrative report was drawn up against the programmer, but in court the man categorically denied the accusations.
According to him, that day he and his girlfriend were heading to the popular tourist location «Pionieve Pole» in the Hlyboka community and had no intention of leaving the territory of Ukraine.
During the hearing of the case, the court noted that the man was detained approximately 20 km from the state border. In addition, there was no photo or video evidence in the case file that would confirm the programmer’s intention to illegally leave the country. The only evidence from the border guards was service reports and a certificate of initial interrogation.
The court also noted that the man did not have a foreign passport or other items that could indicate preparation for crossing the border. «The mere presence of a person at a certain distance from the state border in itself, without other evidence, cannot indicate the person’s intention to illegally cross the state border,» the judge noted in the ruling.
The court concluded that the border service did not provide sufficient evidence to prove the man’s guilt. As a result, the proceedings were closed due to the lack of an incident and the absence of an administrative offense.
The decision specifically emphasizes that, according to the Constitution, a person’s guilt must be proven by proper evidence, and all doubts are interpreted in favor of the citizen.
