According to the case materials, on February 28, the Rakhiv District Court of the Transcarpathian region received materials from the border service department, which contained information that the IT specialist Sirin Software attempted to illegally cross the state border of Ukraine as part of a group of people. The day before, the programmer, the document states, attempted to cross the border outside the authorized checkpoint. The charges are based on the fact that the man was detained near the railway station of the settlement of Rakhiv, 16 km from the state border with Romania.
The AI representative did not appear at the court hearing, asking that the case against him be considered without his participation.
The court concluded that from the evidence presented to the court, it was impossible to establish that the programmer’s actions showed signs that he had crossed or attempted to cross the state border of Ukraine illegally by any means outside the checkpoints across the state border of Ukraine.
Given the above, the court concludes that the specialist’s actions lack the objective aspect of an administrative offense.
