People's Deputies propose to amend the Criminal Code of Ukraine and provide for liability for fraud committed using artificial intelligence systems.

The initiators of the relevant bill were deputies from the "Servant of the People" faction: Serhiy Kuzminykh, Olena Kryvoruchkina, and Heorhiy Mazurashu.

What will change in the Criminal Code?

The document provides for the update of Part 4 of Article 190 (Fraud). According to the proposed changes, fraud committed on a large scale, or through illegal operations using information and communication systems or artificial intelligence systems , will receive a separate legal qualification.

How the law defines AI systems

It is proposed to add a note to the article that clearly defines what exactly will be considered an artificial intelligence system in the context of a crime. These are technological systems (software or hardware-software complexes) that are capable of generating results (content, forecasts, recommendations or decisions) based on received input data that have signs of human intellectual activity.

Special emphasis is placed on technologies used to mislead the victim. In particular, we are talking about deepfakes - tools for replacing or modifying the face, voice, or text data.

How will guilt be proven?

If the law is passed, the Cabinet of Ministers will have a month to bring its regulations into compliance. In addition, the government will have to develop a mechanism for involving specialized cybersecurity experts to verify AI-generated content in criminal proceedings.
