According to the Rules for Crossing the State Border by Citizens of Ukraine, only the procedure for traveling abroad on a business trip is currently clearly regulated. At the same time, the issue of traveling on vacation for booked employees is not enshrined in any regulatory legal act.
The rules for crossing the state border by citizens of Ukraine state that military conscripts who are not subject to conscription during mobilization have the right to cross the state border.
According to paragraph 1 of part one of article 23 of the Law of Ukraine " On Mobilization Training and Mobilization «, military conscripts who are booked for the mobilization period and in wartime are not subject to conscription. Such persons are on special military registration. Despite this, the Rules only specify the procedure for crossing the state border of a booked employee on a business trip. Regarding the possibility of crossing the border during vacation, there is no clear regulatory and legal regulation.
You can learn about the border crossing procedure for this category of persons only from the explanations of the State Border Service of Ukraine. The decision of the State Border Service is made on the spot, explains the Ministry of Justice of Ukraine.
At the same time, the ministry noted that some civil servants cannot cross the border for the purpose of vacation. Such persons are defined in Articles 2-14 of the Rules.
The ministry emphasized that an employee planning to go on vacation abroad should not have any restrictions that would prevent them from leaving the country or violate military registration rules.
Since the Rules change frequently and currently do not provide a clear procedure for traveling abroad on vacation for booked employees, the final decision is made individually — at the discretion of the border guard officer during the control.
The Ministry of Justice recommends that you clarify the crossing procedure with the employees of the State Border Guard Service by phone: 1598 or through other communication channels before traveling.
