As stated in letter No. 41/3 dated September 18, 2025 to First Deputy Prime Minister - Minister of Digital Transformation Mykhailo Fedorov and Minister of Justice Herman Galushchenko, the test environment "contained or provided access" to registry data; the NPU requests that the test be terminated and notarial secrecy be protected.
According to the Chamber, from September 3 to 17, access was "unrestricted"; 830 notaries (≈14%) joined at the start. Some participants were hindered by technical factors, and detailed instructions were published by the State Enterprise "NAIS" on September 15.
The NPU suggests that the learning environment was created based on copies of existing registers or with direct access to them, which calls into question the legality of copying and distributing confidential information. The Chamber requests an audit, blocking unauthorized access, and destroying copies of the data.
The letter indicates possible violations of Article 8 of the Law "On Notaries" (secrecy), Article 1255 of the Central Civil Code (secrecy of wills), and the provisions of the Regulations on the Inheritance Register. It is also noted that "voluntary" testing has turned into pressure with requirements to work weekends and overtime, which is unacceptable for frontline regions.
The Chamber emphasizes: digitalization is supported, but 27 days are not enough, as joint revision of legal and procedural norms, clear access regulations, and enhanced cyber protection are needed. The NPU is ready to work with the Ministry of Justice and the Ministry of Digital Affairs to launch e-notary services without threats to confidentiality.
UPD 16:15: Official position of the Ministry of Digital Affairs : the department called the report about the "drain" of data a fake and assured that the data of Ukrainians is safe. According to the statement of the Ministry of Digital Affairs:

Only notaries, who are obliged to observe notarial secrecy, had access to the test.
The Ministry of Digital Affairs added that from September 3 to 16, the system was tested by about 2,000 notaries, who submitted more than 250 proposals; they are already being processed by the Ministry of Justice and the State Enterprise "NAIS". After finalization, testing for notaries will continue.
According to the plan of the Ministry of Digital, the training and testing phase lasts from September 3 to 30. The NPU insists that in the current configuration, testing creates risks of leakage, so the rules should be changed before continuing.
