The Eighth Circuit Court of Appeals for the U.S. Circuit has suspended the law while it considers an appeal by xAI, a service that uses AI to take a regular photo of a person and generate a version that appears nude.
In its lawsuit, xAI claims that the ban violates the First Amendment to the U.S. Constitution, which protects free speech. Earlier, a lower court denied the company's request to suspend the law, after which it appealed to the appeals court.
The company also says its policies prohibit users from “undressing” images of real people or editing them to show people in a sexual context. The company can suspend or delete accounts for violations of these rules.
Earlier, dev.ua wrote that after the scandal with "undressing" people in photos, X announced new restrictions for Grok. However, it later turned out that the chatbot could still create sexualized images of real people without their consent in private dialogues.
