This is stated in her Facebook post, which notes that the bill provides for the annual provision of data by digital platforms such as OLX, Prom.ua, ROZETKA and others to the State Tax Service about sellers who are registered with them and who have made at least one transaction per year.
«This bill also stipulates that such digital platforms will be tax agents and must withhold personal income tax and military levy from the income received (by sellers — individuals)», — Yuzhanina wrote.
According to her, the Ministry of Finance is «very selectively» implementing the provisions of EU and OECD documents. She claims that the ministry ignored EU Council directives that set thresholds for transactions, above which platforms submit seller data to the tax office.
Nina Yuzhanina points out that in the EU, data is transmitted to the tax authorities only for those sellers whose income from the sale of goods exceeds 2,000 euros or who make 30 or more sales per year.
«In our country, according to the Ministry of Finance, information should be transmitted about all transactions without exception and all funds of an individual should be taxed at 1 hryvnia. And it was this position of the Ministry of Finance that was voiced at the working group discussing this draft law, and other things were also voiced at that meeting (which I don’t even want to write about). People have enough problems, and then there will be more!», — said the MP.
The Ministry of Finance became aware of this initiative at the end of March. It concerns the addition of a new article to the Tax Code of Ukraine, which will determine how operators of digital platforms such as OnlyFans, Glovo, Uklon, Booking must declare income received by their users, i.e. drivers, renters, couriers and other persons who sell goods or provide certain paid services.
The bill stipulates that a person who uses an online platform as a source of income must pay 5% personal income tax (PIT) and 5% military levy, for a total of 10%.
Later, the People’s Deputy from the «Servant of the People» party, Deputy Chairman of the Verkhovna Rada Committee on Finance, Tax and Customs Policy, Olga Vasylevska-Smaglyuk, stated that if a person sells things online more than three times a year, the tax authorities may be interested in this person, because he is a systematic seller.
In response to this, the Chairman of the Finance Committee of the Verkhovna Rada, Danylo Getmantsev, noted that «another betrayal is taking place regarding the tax authorities», which can allegedly find out through checks who is selling goods and accuse them of doing business without registration.
The Ministry of Finance is considering the option of taxing the activities of OnlyFans models, Glovo couriers, Bolt taxi drivers, Booking landlords, and all other users of digital platforms. How much will they have to pay?
