The Verkhovna Rada adopted bill #11044, which repeals the ban on inspections and fines during martial law for employers who humiliate their employees.
«Sudovo-Yurydychna Gazeta» reminds that on December 23, 2022, a law came into force according to which the commission of mobbing of an employee entails the imposition of a fine on citizens from 850 to 1,700 UAH or community service for a period of 20 to 30 hours and the imposition of a fine on individuals — entrepreneurs who use hired labor, officials — from 1,700 UAH to 3,400 UAH or community service for a period of 30 to 40 hours.
Mobbing is the systematic psychological harassment of an employee or several employees in a team, also called «psychological violence at work».
It is noted that bill #11044 was developed due to the increase in the number of appeals to the State Labor Service regarding mobbing. According to its co-author, People’s Deputy Yulia Grishina, she has repeatedly emphasized the need to unblock unscheduled inspections upon the request of an employee or trade union regarding mobbing during martial law.
According to the new draft law, during martial law, the State Labor Service may, at the request of an employee or trade union, conduct unscheduled inspections to identify unregistered employment relationships, mobbing, and the legality of termination of employment contracts.
