According to the protocol on the administrative offense, on June 14, 2025, at about 3:00 p.m., the border guard unit «Checkpoint» in the controlled border area in the direction of border sign https://reyestr.court.gov.ua/Review/128474164 No. 413 on the outskirts of the settlement of Lazeshchyna detected and detained a programmer who, together with five citizens of Ukraine, attempted to illegally cross the state border from Ukraine to Romania outside the established checkpoints across the state border of Ukraine as part of a group of persons.
The AI member did not appear at the court hearing.
The court believes that the case materials lack proper evidence that would confirm that the programmer attempted to illegally cross the state border of Ukraine.
«Thoughts, desires, intentions, and ideas that are not supported by the actual actions of a person are not capable of causing harm to legally protected interests, and therefore are outside the scope of administrative legal regulation,» the court’s reasoning states.
The court decided to close the case against the AIT citizen due to the absence of elements of an administrative offense in his actions.
The court fee in the amount of 605 hryvnias 60 kopecks shall be borne by the state.
An appeal against the resolution may be filed with the Transcarpathian Court of Appeal through the Rakhiv District Court of the Transcarpathian Region within 10 days from the date of the resolution.
