The final text of the crypto law is ready: Binance said whether licensing is possible in Ukraine this year
Discussions around the legalization of the crypto market in Ukraine have been going on for over six years, and only now has the country come very close to the final stage of this process. The emergence of full-fledged regulation will allow Binance to officially launch a local exchange and begin licensing. Binance does not disclose local statistics, but emphasizes: Ukraine is among the top 10 markets in the world by all indicators. In total, the exchange's global base has 320 million users, and among the largest countries are China, Nigeria, Pakistan, Turkey, and the Philippines.
Binance sees huge potential for growth within Ukraine. The company’s goal for 24 months is to attract 10 million Ukrainians who are already active e-commerce users.
"We are in a very productive dialogue with all possible regulators: the Ministry of Digital Transformation, the National Securities and Markets Commission, the National Bank, and the deputies. The deputies are currently considering amendments to the draft law," said Kyrylo Khomyakov in an interview with Forbes Ukraine.
We will remind you that the compromise version of the document was supported by the Verkhovna Rada in the first reading, after which thousands of amendments were submitted to it. Binance actively provided its comments and suggestions. The goal of the world's largest crypto exchange is to help balance the bill in a way that protects users, increases the country's tax base, and at the same time does not kill innovation.
According to Khomyakov, the final text of the law is already ready, and it will soon be submitted to parliament for approval.
"The market regulators will be the National Securities and Markets Commission and the National Bank of Ukraine," adds Khomyakov. "If nothing changes, both regulators should prepare bylaws to begin the licensing process. This will take about six months. That is, nothing will change for the market this year."
Kyrylo Khomyakov emphasizes that the main architecture of future regulation will be formed precisely at the stage of secondary legislation.
First, it is the protection of personal data. There is an ongoing discussion about this. According to the draft law, exchanges will not be tax agents, and this is pleasing.
“Secondly, the tax burden. The vast majority of users are willing to pay reasonable taxes and receive official confirmation and the right to use crypto assets. The proposed tax rate is currently quite high — 23%. I would like it to be lower. A lower level and an additional transitional grace period for tax for individuals were proposed. The availability of futures and derivative products, the size of credit trading leverage will be formed in subordinate legislation,” explains the regional top manager.
Binance does not plan to obtain a full banking license in Ukraine, as the company does not intend to engage in classic lending or deposit-taking. Instead, the focus will be on expanding financial opportunities for users: opening cards and accounts in hryvnia, ensuring domestic and international payments, as well as providing tools for investing in traditional stocks, precious metals, etc.
The company's strategy is built on partnerships with already licensed financial institutions. Instead of directly purchasing a bank, Binance is developing a flexible integration model through Crypto-as-a-Service solutions, providing a backend for financial institutions and expanding its network of payment providers across jurisdictions.
The company is also considering launching trading in domestic government bonds (OVDP), if future regulatory regulations and technical infrastructure allow. Binance emphasizes that it seeks to adapt all locally demanded products to the needs of Ukrainians, because the company's goal is not just to be the largest global exchange, but the best local platform in Ukraine.
