The Ministry of Digital Transformation has published two new draft laws designed to improve the rules for regulating the gambling market.

According to the press service of the Ministry of Digital Affairs, the first draft law is designed to amend the current law on state regulation of gambling and improve certain provisions on the protection of players' rights.

It provides, in particular:

  • an obligation for gambling organizers to monitor gaming behavior and respond to signs of risky addiction;
  • the opportunity for the player to set personal limits and self-restrict;
  • a clear gradation of violations for licensees and proportionate sanctions.

«This will help create conditions for a more transparent and accountable market, gradually reduce the shadow segment, and increase budget revenues,» the ministry assures.

At the same time, another bill proposes to introduce new rules for taxing the gambling sector, because, according to the Ministry of Digital Affairs, «the current tax model contains many gaps and contradictions.»

«In particular, the tax on income from gambling activities and the tax on corporate profits are applied simultaneously. As a result, the same economic base is actually taxed twice,» the Ministry of Digital Affairs specified the problem.

Meanwhile, the new tax bill in this area proposes:

  • establish a single tax rate on income from gambling organizations — 18%;
  • eliminate double taxation;
  • determine that the tax on winnings is paid from the player’s real income — the difference between the deposited funds and winnings;
  • verify the business’s tax reporting with the data of the State Online Monitoring System;
  • to schedule tax audits in case of significant discrepancies in data.

According to Deputy Minister of Digital Transformation Natalia Denikeeva, the legalization of gambling in 2020 was the first step towards bringing the market out of the shadows, but legality in itself does not guarantee effective control.

«The market has grown faster than state oversight tools, and today our task is to move from formal regulation to systemic, digital control of this industry,» she noted.

The draft laws are currently available for public discussion, but the timing of their submission to parliament has not been announced.

As dev.ua reported, the State Budget received UAH 72.6 million after issuing new licenses to lottery operators.

PlayCity previously identified three applicants for lottery licenses and announced the launch of a new market control model.
