According to the case materials, on an unspecified date and time, the accused developed a criminal intent aimed at producing and distributing pornographic video productions with the participation of a person, the materials regarding whom have been separated into separate proceedings, which are in clear contradiction with the existing traditions of intimate communication between people under the following circumstances.
The accused intentionally committed actions aimed at distributing pornographic video productions with the participation of a third party.
In order to carry out his criminal intent to distribute pornographic video products, he created an account on the website onlyfans.com in the name of another person, using their personal data during registration.
On January 17, 2022, the defendant posted a pornographic video on the specified Internet resource, previously created and sent to him by an accomplice.
As a result, after downloading the video, users of the web resource began viewing a pornographic video.
The defendant committed similar actions systematically until July 2023, the case materials state.
And on September 27, 2024, a plea agreement was concluded between the prosecutor of the Central District Prosecutor’s Office of the city of Dnipro.
The court approved the agreement and decided to find the man guilty of distributing pornographic content. Initially, the court sentenced him to imprisonment with the deprivation of the right to hold positions related to IT technologies or engage in activities related to the distribution of information of any nature on web resources for a period of 1 year. Then the sentence was mitigated and the businessman was sentenced to imprisonment with a probationary period of 1 year.
The man must also pay the state the cost of conducting examinations in the amount of UAH 15,145.6.
The verdict may be appealed to the Dnipro Court of Appeal within thirty days from the date of announcement.
