The instructions of the National Commission for the Protection of Communications will become mandatory even in peacetime, and will be valid for another six months after the war. A new telecom bill has been submitted to the National Commission for the Protection of Communications.
The National Center for Operational and Technical Management of Networks (NCUT), whose orders to block websites or operate base stations during blackouts are carried out by operators in times of war, wants to consolidate its influence on the industry. A draft law with amendments to the Law "On Electronic Communications" has been submitted to the telecom regulator NKEK for approval.
The document was developed by the State Special Communications Service at the request of the SBU (the letter was received in the fall of 2025). The main goal is to close the legal "holes" around the ATO and, most interestingly, to specify the powers of the National Security Service in peacetime.

dev.ua figured out what exactly they want to change for Ukrainian providers and operators.
1. Wartime orders will remain in effect for another six months after their cancellation Currently, the law does not clearly define when the Center's "military" requirements expire. The draft law proposes to fix the deadlines directly in the text of the law: — Orders of the National Civil Service Commission issued during a state of war or emergency will remain in effect for another 6 months after the date of its termination or cancellation. — The orders of the ATO period will be in effect until the official termination of the operation. — If it is an emergency situation (for example, a man-made disaster or accident) — until the consequences are eliminated.
2. The NCU enters peacetime (new Article 32¹) Now operators are required to listen to the NCU only under special conditions: war, a state of emergency, or an emergency situation.
The authors of the draft propose adding a new Article 32¹ — “Operational and technical management in peacetime,” and enshrining in Article 18 the unconditional obligation of providers to comply with these instructions. The logic of the security forces is simple: it is necessary to prepare backup routes, check the stability of lines, and reserve resources for defense in advance, and not when it has already “arrived.” What exactly will be required in peacetime — the Cabinet of Ministers will write separately.
3. Full powers during the ATO The law on combating terrorism contains a provision on communication restrictions, but the relevant law on electronic communications simply forgot to specify the powers of the NCU for the ATO format. Now this is being corrected: during an anti-terrorist operation, the Center will be able to issue mandatory instructions to all operators in the zone of action, and if hardware or routing requires it, even to those providers whose equipment is located outside the zone.
4. Media people will not be touched To avoid conflicts with the Law "On Media", an exception was made for TV and radio broadcasters. In peacetime, the NCU's instructions will not apply to broadcasting networks - the main regulator there remains the National Council for Television and Radio Broadcasting. Who will punish for disobedience?
The NCU itself does not become a regulator or supervisor. If the provider ignores the order (both peaceful and military), the NKEC will be involved - it is it that has the authority to carry out inspections and fine violators of license conditions. At the same time, the law separately fixes the procedure for judicial appeal of the Center's orders.
The explanatory note notes that the law will not require money from the state budget, and the regulatory expertise of the State Revenue Service is not required. The floor is now on the National Commission for the Evaluation of Energy Efficiency and the Parliament.
