Now, Musk’s companies X and xAI are seeking billions of dollars in damages in a lawsuit, arguing that Apple’s decision to integrate OpenAI into the iPhone operating system hinders competition and innovation in the artificial intelligence industry and harms consumers.
The lawsuit claims that Apple and OpenAI’s «exclusive agreement» made ChatGPT the only AI chatbot integrated into the iPhone and «locked markets to preserve their monopolies and prevent competition from innovators like X and xAI.»
Thus, Musk’s companies in their lawsuit accused Apple and OpenAI of unfairly favoring the latter and hindering competition for other chatbot manufacturers.
According to Bloomberg, the lawsuit was filed on Monday in federal court in Fort Worth, Texas.
In addition to monetary compensation, the lawsuit seeks an injunction that would prohibit Apple and OpenAI from continuing their allegedly «illegal agreement.»
Recall that Apple and OpenAI have a partnership in the field of artificial intelligence, and Musk has a long-standing feud with OpenAI CEO Sam Altman.
The publication recalls that some of the allegations in Musk’s lawsuit echo those made by the US Department of Justice against Apple. The US sued the iPhone maker in federal court in New Jersey in March 2024, claiming that the company monopolized the smartphone market by blocking competitors from accessing hardware and software features on its popular devices. At the same time, Apple lost an attempt to dismiss the case in June.
Apple has so far responded by stating that the App Store is «designed to be fair and free from bias.» In turn, Altman recalled how biased Musk is in running his X network, manipulating it to serve personal interests.
Interestingly, according to media reports, in the partnership between Apple and OpenAI, «not everything is so clear: Apple is forming a new team called Answers, which is developing an internal analogue of ChatGPT. After all, the company intends to create its own search engine based on artificial intelligence, which will allow users to get answers to queries without having to use third-party services.
