According to the case materials and the protocol on the administrative offense, in the controlled border area near the Yasinya railway station on April 10, 2025, at about 11:15, the border guard unit detected and subsequently detained two men, one of whom is an EPAM member. During the detention, he maliciously disobeyed the lawful request of a serviceman of the State Border Service of the Republic of Ukraine during the performance of his official duties related to the protection of the state border — he resorted to escape and repeatedly repeated the demand to stop the illegal actions.
The programmer did not appear at the court hearing. His lawyer explained that the IT worker , along with his wife and friend, arrived at the Yasinya railway station by train from Kyiv with the intention of traveling to the Oriana hotel located at the Dragobrat ski resort to participate in a retreat seminar and then return to the capital on April 14, 2025.
After getting off the train, the programmer and his friend went to the Nova Poshta branch to pick up the items that had been sent from Kyiv to ensure participation in the seminar.
But on this way they were stopped by a man who introduced himself as a serviceman of the State Border Guard Service and, using prohibited means, forced them to reach a service car, in which both Kyiv residents were taken to the Border Guard Service Department. In particular, the case states that the man, who called himself a border guard, while dressed in civilian clothes, rushed after the programmer and his friend. Having caught up with them, he behaved rudely and illegally, and in addition, he used a special means. Aityvets, in turn, explained to the court in writing that he did not resist. He did not admit his guilt.
The court, having considered the arguments of the parties, decided to close the case due to the absence of elements of an administrative offense in his actions.
The court fee in the amount of 605 hryvnias 60 kopecks shall be borne by the state.
An appeal may be filed against the resolution to the Transcarpathian Court of Appeal through the Rakhiv District Court of the Transcarpathian Region within 10 days from the date of its promulgation.

Чоловік не пред'явив службове посвідчення це перше друге застосував спец засіб я так розумію балончик з газом скоріш за все, в такому випадку хлопець міг застосовувати силу для самозахисту і це законно.
