The case materials, which are being considered by the Velykobereznyanskyi District Court of the Transcarpathian region, state that on May 2, 2025, at about 6:20 p.m., a border guard inspector for alpine training on the outskirts of the settlement of Strychava, Uzhhorod district, at a distance of about 5,200 meters from the state border of Ukraine, detained a programmer who «on foot attempted to illegally cross the state border into the Slovak Republic outside the established state border checkpoints under martial law.»

The programmer did not appear for the hearing, but he did provide the court with an explanation that the programmer has a reservation until January 30, 2026, according to the information in the military registration document from the «Reserve+» database.

Thus, having the right to move freely within the territory of Ukraine, the man and his cohabitant, through the online registration form on the website «9th Kyiv Gestalt Intensive — NAGTUNAGTU», registered and paid for participation in the period from April 28, 2025 to May 9, 2025 in the intensive «19th Kyiv Gestalt Intensive in the Carpathians», which was organized by the National Association of Gestalt Therapists of Ukraine and the Kyiv Institute of Gestalt Therapy for more than 80 people living in the village of Sil, Transcarpathian region.

The case materials also state that the man had two return tickets to Kyiv, meaning he had no intention of crossing the border.

As for the circumstances of the detention, the programmer, together with his fellow students, went for a walk on the nearest mountain from the Edelweiss camp. At the top, they stopped for a rest. After the rest, the group began the descent. At approximately 4 p.m., the group in full formation completed the descent and at about 4:30 p.m., they met a border patrol. After inspecting the programmer’s belongings, he was first released, and then forced to go to the border post to give an explanation.

Already at the Border Service department, when the man arrived at about 5 p.m., his passports were confiscated, he was interviewed again, and his belongings and phone contents were examined. At about 9:15 p.m. PERSON_3 was presented with a drawn-up protocol on administrative detention and a protocol on personal search, inspection of belongings and seizure of belongings and documents from. The programmer was also offered to write an explanation regarding the circumstances of the detention. He familiarized himself with the contents of such protocols and signed the documents provided, and also wrote an explanation regarding the circumstances of his stay near the tourist base and training in the psychological intensive care unit. At the same time, according to the man’s explanations, the protocol on administrative offense was not presented to him for review and a second copy was not handed over. The protocols on administrative detention and the protocol on personal search, inspection of belongings and seizure of belongings and documents were provided for review and signature in one copy. There is no evidence in the case materials that the programmer was explained his rights.

Having studied the case materials, the court closed the administrative offense case against the programmer due to the absence of elements of an administrative offense in his actions.

The resolution may be appealed by the person held administratively liable, his legal representative, defense attorney, victim, or his representative to the Transcarpathian Court of Appeal through this court within 10 days from the date of its issuance.
