From the protocol on the administrative offense of the series dated July 29, 2025, it is seen that at 6:10 p.m., the AIT citizen was detected by the border guard unit «Checkpoint» in the area of responsibility of the border guard department, located on the territory of the Khotyn Autonomous Okrug of the Dnistrovskyi district of the Chernivtsi region on the outskirts of the settlement of Ataki, for attempting to illegally cross the state border of Ukraine outside the established checkpoints across the state border of Ukraine.
The programmer did not appear at the court hearing, but in his written explanations he explained that he was traveling to the Ivano-Frankivsk region for vacation and had no intention of illegally crossing the state border.
Having examined the case materials and assessed the evidence provided to the court, the court concluded that the report of the border guard inspector shows that he stopped the vehicle in which the IT worker was. This citizen was unable to confirm the purpose of his stay in the controlled border area. Other evidence did not confirm the programmer’s intention to cross the State Border of Ukraine outside the checkpoints.
A report on an administrative offense and explanations from a border guard inspector alone, in the absence of other evidence, are not sufficient for a court to conclude that a person is guilty.
The judge decided to close the administrative offense case against the IT specialist.
The resolution may be appealed within ten days from the date of its issuance to the Chernivtsi Court of Appeal through the Khotyn District Court of Chernivtsi Region.
