A leading programmer at JSC CB PrivatBank is seeking the restoration of his right to work and recovery of his average salary after the bank illegally fired him in October 2024. We tell you the details.
According to the case materials, in November 2024, the programmer filed a lawsuit demanding that the order on his dismissal be canceled and that he be reinstated as the lead programmer of the Department for the Development of Authorization Systems. He also demanded that his former employer recover his average earnings for the period of forced absenteeism.
Then the Central District Court of Dnipro refused to satisfy the claim.
The Court of Appeal partially satisfied the claim: the dismissal was declared illegal, the programmer was reinstated, and the bank was obliged to pay over UAH 1.2 million in average earnings for the entire period of forced absenteeism.
PrivatBank filed a cassation appeal, which was initially returned due to a violation of the deadlines. On December 7, 2025, the bank re-applied to the Supreme Court, providing an explanation for the missed deadline.
The Supreme Court recognized the circumstances as serious and renewed the deadline for cassation appeal, opened cassation proceedings, and also stayed the execution of the appeal decision, except for the payment of the average salary for one month (100,309 UAH), which is subject to immediate execution.
Currently, the parties can file a response to the cassation appeal until January 26.
