A Lviv woman found a buyer for her iPhone 15 Pro Max, which she was selling for UAH 46,000. It was a young unemployed man from Odessa with no previous criminal record. When they met, he handed the woman an envelope with $900. When the owner opened it, she saw fake money. As it turned out, it was souvenir dollars bought in a store: nine 100-dollar bills with the inscriptions: "it's not the money, it's a joke."
The woman tried to return her phone, but the man ran away with it. The meeting was at 24 Vasyl Stus Street, and the thief was caught in the Zalizny Vody Park.
"The man repented of his actions, asked not to be severely punished and gave his consent to the consideration of criminal proceedings in accordance with the procedure provided for in Part 3 of Article 349 of the Criminal Procedure Code of Ukraine, stating that he understood the meaning of these circumstances. He also noted that he tried to reconcile with the victim and intended to compensate the victim for the moral damage caused by making several payments against a receipt, but the latter insisted on compensation for the damage in full and in a significant amount for him, which he could not do due to the lack of earnings," the verdict of the Sykhiv District Court of Lviv states .
The victim supported the prosecutor's position and requested that the husband be sentenced to 7 years in prison. Here are her arguments:
she has suffered moral and material damage;
she was without a phone for a long time, and therefore felt discomfort;
The iPhone 15 Pro Max was in the police's possession as physical evidence, and during this time its value decreased;
sold her phone to buy a new one, as a result, she had to borrow money for it;
while she was chasing the thief, she lost her car keys, which later cost her 10,000 UAH;
did not receive the promised moral compensation from him, which was the only condition for her not to file a lawsuit, although the man rented an apartment in the center of Lviv, which means it can be assumed that he has money.
The Odessa man's defense attorney tried to mitigate the sentence due to his young age and guilty plea, but the court considered this not enough and imposed a sentence of 7 years in prison.
