Kharkiv programmer Volodymyr Korotetsky has been suing the IT company Ciklum for almost half a year, demanding that he be reimbursed tens of thousands of hryvnias for services under a contract from 2015. The trials are ongoing.
Interestingly, the plaintiff is acting as an individual entrepreneur in the case. However, his individual entrepreneur was registered only six months ago.
According to the register of court decisions, Korotetsky filed his first lawsuit with the Kyiv Commercial Court back in July of this year. The developer demanded that Ciklum collect UAH 49,640.69 in debt under a service contract dated August 5, 2015. What exactly the programmer did under the contract is not specified in the case materials.
By the decision of the Kyiv City Commercial Court of July 15, 2024, the said statement of claim was left without motion, and the applicant was given a period to eliminate the deficiencies indicated in it. Subsequently, the court accepted the statement for consideration and initiated proceedings in the case.
On October 11, the Economic Court of the capital refused to satisfy Korotetsky’s claim against Ciklum for the recovery of UAH 49,640.69, since the plaintiff did not provide proper evidence to support his arguments regarding the existence of grounds for recovering the debt from the defendant.
On October 17, the programmer filed an appeal against the decision of the Kyiv Economic Court. Appeal proceedings were opened. However, the results of the review have not yet been made public.
The IT-FOP did not stop there. And on October 18, he filed a new lawsuit with the Economic Court of the capital. This time, the programmer’s demands were to recover from Ciklum a different amount of principal debt under the service agreement dated August 5, 2015 — UAH 30,000. He also demands compensation for UAH 3,003 in penalties. The court accepted the statement of claim for consideration and opened proceedings in the case. However, the court refused the plaintiff’s request to consider the case with the summons of the parties, and will consider it online in a video conference mode. The court hearing is scheduled for December 12. However, the results of the consideration have not yet been made public.
On October 21, 2024, Korotetsky again appealed to the Economic Court of the capital. This time, with a demand to declare the additional agreement of December 1, 2021 to the agreement of August 5, 2015 invalid. The court accepted the application for consideration and opened proceedings in the case. The case will also be considered via video conference. However, on December 9, the court decided to extend the term of the preparatory proceedings for 30 days.
The defendant company is not currently commenting on the situation, awaiting the court’s final conclusions on the cases described above.
