As noted by the Executive Secretary of the National Council, Olena Nitzko, the topic of AI regulation is being discussed particularly actively after the European Law on Artificial Intelligence came into force on August 1.
«For Ukraine, the implementation of the law on artificial intelligence is important given that we have the status of a candidate for the European Union, and the law introduces a single structure for all European countries. Of course, we do not yet have legislative bases, but there are very serious developments of the Ministry of Digital Affairs, the National Council, and specialized experts who have created recommendations. There are already many high-quality guides, and we treat them as «soft law,» the member of the National Council specified, quoted by the body’s press service.
dev.ua decided to clarify whether a specific legislative act will be developed and submitted regarding the regulation of artificial intelligence according to the European model, since the event was about abstract «developments.» We addressed this question to National Council member Oleksandr Burmagin, who moderated the aforementioned event.
«In fact, work on developing such legislation is not underway yet. The Ministry of Digital Affairs announced at the event that they plan to begin this work in 2027. I also clarified with them why 2027, but they replied that they plan to follow an evolutionary path, gradually — so that business and society as a whole get used to the fact that AI must be used responsibly and certain tools must be verified,» noted Burmagin, adding that there is not even any movement towards legislative regulation of AI in Ukraine yet.
In addition, Oleksandr Burmagin added that in the EU, the process of legislative regulation of AI is also undergoing some adaptation.
«Now all these mechanisms in the EU are just being set up, there should be a large number of annexes (to the law — ed.), and, in fact, they (the Ministries) believe that there is no point in running now, because this regulation in the European Union is only being developed, and certain approaches may also change there in a year or two. If we develop something now and adopt it, then it may have to be rewritten and brought into line,» said a representative of the National Council in a comment to dev.ua, emphasizing that recommendations in various areas are currently being developed, not a legislative act.
Petro Bilyk, a member of the expert advisory committee on the development of the AI sector in Ukraine under the Ministry of Digital Affairs, head of the AI practice at Juscutum Law Firm, recalled that the first provisions of the European Law on Artificial Intelligence (AI Act) will come into effect in February 2025, and its implementation is expected to last 3 years.
«The act provides for different classifications of risks and gives examples of systems that will be prohibited in the EU. The latter relate, for example, to manipulation — an algorithm that influences the user’s final choice, prompts them to take certain actions, political choices that the user would not have made without it. Also, the exploitation of vulnerable groups (targeting financial services to low-income people), crime prediction, facial recognition, emotion analysis, biometric categorization, etc.,» he explained.
As dev.ua previously wrote, the Council of Europe Convention «On Artificial Intelligence and Human Rights, Democracy and the Rule of Law» was signed by the European Union, the United States, the United Kingdom and seven other countries.
Last year, the Ministry of Digital Affairs announced that they planned to regulate artificial intelligence in Ukraine and already had four possible strategies.
