India’s IT sector is in a prolonged period of uncertainty, and clients using the services of Indian programmers are postponing signing long-term contracts or revising their terms.

According to Reuters, this situation in India is caused by the fact that the United States is discussing the introduction of a 25% tax for American companies that use foreign outsourcing services.

The publication predicts that the relevant bill is unlikely to be adopted in its original form, but, nevertheless, it could significantly affect large companies that use IT outsourcing services in other markets, one of the most popular of which is India.

According to analysts and lawyers, American firms that would be forced to pay such a tax but are directly dependent on foreign IT services are likely to resist this initiative, including in the courts.

Reuters notes that India’s IT sector exports software services to giants such as Apple, American Express, Cisco, Citigroup, FedEx, Home Depot and other large American companies. However, this has drawn criticism in consumer countries due to the loss of jobs that are being replaced by much lower-paid workers from India.

So, last week, Republican Senator Bernie Moreno introduced a hiring bill that proposes to tax companies that hire foreign workers instead of Americans.

«This bill proposes sweeping changes that could transform the economics of outsourcing and significantly increase tax liabilities associated with international service contracts,» commented Jignesh Thakkar, Head of Compliance, EY India.

Lawyers predict that American outsourcing-oriented companies will almost certainly challenge it in court.

«Such a bill would likely face a lot of backlash from American companies that rely heavily on outsourcing, and who would likely file lawsuits to challenge various aspects of the bill if it were ever passed,» said Sophie Alcorn, CEO of Alcorn Immigration Law.

As dev.ua reported, Ukrainian N-iX opened an office in India, where the first specialists are already working. 600–1000 candidates applied for one vacancy during employment there.

In March, we wrote that IBM was conducting large-scale layoffs in the US, and the company has significantly more open positions in India than in the US, confirming the assumption that a significant portion of work is being outsourced.
