The Ministry of Economy has updated the criteria for recognizing enterprises as critical to the functioning of the economy. According to the new order dated June 24, 2026, the government has introduced strict salary thresholds that will directly affect IT companies, startups, and representative offices of foreign technology businesses seeking to book their specialists.

As NV reports , citing the Ministry of Economy Resolution No. 6954, the biggest changes concern financial requirements for the general list of enterprises. Now, companies employing more than 50 people must ensure an average salary in the staff at a level not lower than the national average for the last year, multiplied by a factor of 2. For smaller businesses with 20 or more employees, the conditions are even stricter - their average salary must exceed the national indicator three times.
Separately, the conditions for permanent representative offices of non-resident companies, a format often used by international IT corporations in Ukraine, have been tightened. For them, the minimum average salary must now also be three times higher than the national average, while the previous version of the document used a coefficient of 2.
The rules for businesses with inter-regional status, i.e. those operating in three or more regions (for example, having multiple development hubs), have also changed. To qualify for criticality status, such a company must have a staff of 10 or more people, as well as pay taxes and a single social contribution of at least 24,000 hryvnias in each of the regions for the last three months.
At the same time, a number of general criteria remained unchanged. The status of critical, as before, can be obtained by residents of industrial parks, enterprises that have state grants, manufacturers of Ukrainian equipment under state programs, or companies that provide services to the Ministry of Economy under contracts lasting six months or more. As for the agricultural and forestry sectors, the government has also significantly increased the requirements for land area and annual income for them.
