State Agency "Placity" appeals court decision in favor of Megogo and GGBet in gambling advertising case
The Sixth Administrative Court of Appeal agreed to consider the appeal of the State Agency of Ukraine «Placity» against the decision by which the GGBET company achieved the cancellation of one of the decisions of the liquidated Commission for the Regulation of Gambling and Lotteries (KRAL). As follows from the ruling of July 30, in June the Kyiv District Administrative Court sided with LLC «GGBET» in a dispute with KRAIL. The court declared unlawful and overturned one of the regulator’s decisions concerning the company’s activities in the Ukrainian gambling market.
After that, the State Agency «Placity» (the successor of Krail) filed an appeal, trying to challenge the verdict. First, on July 25, the appeal court left the complaint without moving due to procedural shortcomings, but after they were eliminated, the proceedings were reopened.
The appellate court’s ruling notes that the complaint was filed within the established time frame and meets the requirements of procedural law. The court saw no grounds for refusing to open proceedings.
The parties had until August 13 to submit responses and additional evidence. Case materials No. 320/53261/24 have been requested from the court of first instance. A date for the appeal has not yet been set, but after receiving the case, the Sixth Administrative Court of Appeal will determine a hearing schedule.
KRAL, which was liquidated in May 2024, was responsible for regulating the gambling market in Ukraine. GGBET operates in the field of sports betting, and Megogo appears as a third party in this case. The preliminary decision in favor of GGBET may have implications for regulatory practices and control in the gambling business, as it calls into question the legality of some of the decisions of the former commission.
