The Finance Committee of the Rada unanimously supported the bill on virtual assets. What taxes will cryptocurrency owners face?

The Verkhovna Rada of Ukraine’s Finance Committee unanimously supported the revised draft law on the regulation and taxation of virtual assets. What is known about changes in the crypto-asset market?

People’s Deputy and Chairman of the Verkhovna Rada Committee on Finance, Tax and Customs Policy Yaroslav Zheleznyak confirmed that the adopted draft law provides for a tax grace period for 2026 at the level of 5%.

Announcing on April 22 the Committee’s consideration of a document containing over 200 pages and combining all the main issues regarding cryptoassets: regulation of circulation, status of regulators, taxation, the Chairman of the Verkhovna Rada Finance Committee, Danylo Hetmantsev, shared the points of the draft law that relate to taxation and the transition period.

For transactions with virtual assets, the bill provides for taxes for crypto entrepreneurs, in particular:

  • Tax will be levied only on the profit for the year. The difference between what the crypto-asset owner spent on the acquisition of crypto-assets during the reporting annual tax period and the income he received from the sale of these assets is taxed.
  • In the first year after the adoption of the document , a preferential personal income tax rate of 5% will apply. During this period, it is not necessary to confirm the costs of purchasing cryptocurrency. In the future, such confirmation will be mandatory.
  • After the transition period ends, cryptocurrency holders must pay 18% personal income tax and 5% military levy. Crypto entrepreneurs must declare and pay taxes on their own.
  • Three categories of crypto transactions will not be subject to taxation: exchanging one cryptocurrency for another; selling for an amount up to one minimum wage; and mining.
  • The draft law states that the market regulator will be determined by the Cabinet of Ministers in consultation with the National Bank. It is not yet clear what body will regulate the sector — the National Securities and Markets Commission, the National Bank, and the Ministry of Digital Affairs are considering it.

Parliament will likely be able to consider the bill as early as next week.

About context

In January 2024, two draft laws were registered in the Verkhovna Rada to regulate the circulation of virtual assets — No. 10225 from the National Securities and Stock Market Commission (NSSMC) and an alternative No. 10225-1 from the Ministry of Digital Economy. Both draft laws are based on the MiCA directive, but differ in issues related to the classification and taxation of cryptocurrency transactions.

In January, the first deputy head of the NBU, Kateryna Rozhkova, said that the NBU does not plan to legalize cryptocurrency as a means of payment. She noted that Ukraine adheres to the position of the International Monetary Fund, which has repeatedly opposed the recognition of cryptocurrency as a legal means of payment.

In early March, Kateryna Rozhkova stated that the law on virtual assets in Ukraine should be ready by October 2025, which will be based on the European Markets in Crypto-Assets (MiCA) directive.
